Temporary Protected Status for Haiti remains valid through February 3, 2026
On July 1, 2025, the U.S. District Court for the Eastern District of New York ruled that Department of Homeland Security (DHS) Secretary Kristi Noem exceeded her statutory authority by attempting to shorten Haiti’s Temporary Protected Status (TPS) designation. The court held that the TPS statute outlines a specific, exclusive process for terminating a country’s designation—one that DHS did not follow. As a result, the court set aside the DHS’s action under the Administrative Procedure Act (APA).
Consequently, Haiti’s TPS designation remains valid through February 3, 2026, and the legitimacy of the July 1, 2025, termination notice is now in question.
