Elimination of Automatic Extension for Many EAD Categories
Effective October 14, 2026, USCIS has implemented a final rule eliminating automatic extensions of employment authorization documents (EADs) for numerous categories that previously received up to 180 days of continued work authorization upon filing a timely renewal. Adjustment applicants, asylum applicants, H‑4 and E‑dependent spouses, VAWA self‑petitioners, and many other categories governed by 8 C.F.R. § 274a.13(d) must now cease employment upon EAD expiration unless a new card is approved. Only categories with statutory or separately published automatic extensions—such as Temporary Protected Status (TPS), and F‑1 student EADs — including OPT, STEM OPT, and economic‑hardship EADs —remain unaffected. Employers and employees should review upcoming expiration dates carefully, as timely renewal filings no longer preserve work authorization during processing.
