USCIS Issues Rule Allowing Mandatory Electronic Filing

USCIS has released a new regulation (Aug. 11, 2026) that gives the agency authority to require mandatory electronic filing for any immigration application or petition. Nothing changes immediately—current paper filing options remain available—but USCIS can now designate specific forms for mandatory e‑filing through future notices. This may eventually affect common employment‑based filings such as H‑1B, L‑1, I‑140, I‑485, I‑765, and dependent applications. 

We anticipate phased implementation.  Forms already available in the USCIS online portal (e.g., I‑539, I‑765, N‑400) are likely candidates for early mandatory e‑filing. 

This is not anticipated to impact any cases already pending.
